Terms of Service

Welcome to Cibo. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and TunariVPN Sp. z o.o., a company registered under the laws of Republic of Poland, with its registered office at Zabraniecka 8L / 212, 03-872 Warsaw, Poland (NIP 7011263037, REGON 541903542, KRS 0001176044) (“Cibo,” “we,” “us,” or “our”). By accessing or using our Service, you agree to be bound by these Terms in their entirety.

1. Acceptance of Terms

By creating an account, downloading our application, or otherwise accessing or using Cibo (the “Service”), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

You must be at least 16 years of age to use Cibo. By using the Service, you represent and warrant that you meet this age requirement.

2. Service description

Cibo is an AI-assisted calorie and macronutrient tracking application for iPhone and Apple Watch. The Service includes:

iOS application with Apple Watch companion + Live Activity
AI-powered meal logging via photo (vision model), voice (speech-to-text), text shorthand, and barcode scan
Daily calorie + macronutrient tracking, history, and analytics
Optional two-way Apple Health integration (read steps + energy, write meals)

3. Account registration

Cibo uses Sign in with Apple for authentication. By signing in, you agree to the additional terms Apple sets for that flow. You are responsible for:

The Apple ID associated with your account
All activities that occur under your account
Notifying us at [email protected] if you suspect unauthorized access

You may not create multiple accounts to abuse free-tier limits, share your account credentials with third parties, or use automated means to interact with the Service.

4. Subscription plans + billing

4.1 Plans

Cibo offers a Free plan and paid Monthly and Yearly subscriptions. The features and pricing of each plan are displayed in the app at the point of purchase.

4.2 Payment

All payments are processed through Apple In-App Purchases and are governed by Apple's terms in addition to these Terms. We do not see your card details.

4.3 Auto-renewal

Paid subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. Cancellation is managed through Apple in Settings → Apple ID → Subscriptions on your iOS device. We cannot cancel an Apple subscription on your behalf.

4.4 Price changes

We reserve the right to modify subscription pricing. Apple's standard notification flow applies — Apple emails you at least 30 days in advance of any price increase and asks you to opt in. If you don't opt in, your subscription stops at the end of the current period.

5. Free tier + trial

The Free plan is available indefinitely with a limit of 20 AI logs (photo, voice or text) per calendar month, resetting on the 1st. Barcode scanning and manual entry are unlimited.

Each Apple ID is entitled to one free trial only. Apple enforces this rule across all apps in the same subscription group.

6. Refunds

Apple processes all refunds for in-app purchases. To request a refund:

Visit reportaproblem.apple.com
Select the Cibo charge you want refunded
Choose the appropriate reason

Apple's standard refund window is 14 days from the original charge, though Apple may grant refunds outside that window at its discretion.

7. Acceptable use

You agree to use Cibo only for lawful purposes. You shall not:

Use the Service in a way that violates applicable local, national, or international laws
Submit photos or descriptions of content other than food (e.g. people, documents, intellectual property of third parties)
Attempt to reverse-engineer the AI prompts, decompile the application, or extract our model outputs in bulk
Use the Service in a clinical or diagnostic capacity (Cibo is not a medical device — see Section 8)
Attempt to gain unauthorized access to other users' accounts or our backend systems
Distribute malware, perform abusive scraping, or DDoS our servers
Resell, redistribute, or sublicense the Service without our prior written consent

We reserve the right to suspend or terminate access without refund for violations of this policy.

8. AI output + medical disclaimer

Cibo's nutrition resolution relies on AI vision and language models. These models are statistical and can be wrong. Calorie and macro estimates are approximations, not exact measurements. You acknowledge that:

AI-resolved values may differ from the actual nutrition content of your meal by 10–25% in either direction
Cibo is a personal awareness tool, not a medical device, and is not intended to diagnose, treat, cure, or prevent any disease
Data shown by Cibo or imported from Apple Health should not be relied on for medical decisions, and you should consult a qualified healthcare professional before making changes to your diet, exercise, or medication — especially if you are pregnant, nursing, managing a medical condition, or recovering from an eating disorder

9. Intellectual property

The Service — including all software, applications, website content, logos, trademarks, the “Cibo” brand, design system, AI prompts, and any other materials — is the exclusive property of TunariVPN Sp. z o.o. or its licensors and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Cibo applications solely for your personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of our Service or software.

You retain all rights to the meal data, photos, and voice clips you submit to the Service. By submitting them, you grant us a limited license to process that content solely for the purpose of providing the Service to you (resolving nutrition, syncing your history, generating analytics).

10. Service availability

We strive to maintain high availability of the Service. However, Cibo is provided on an “as is” and “as available” basis. We do not guarantee:

Uninterrupted, error-free, or completely secure operation
That the Service will meet your specific requirements or expectations
Specific AI nutrition resolution accuracy (see Section 8)
Continuous availability of any specific third-party integration (Apple Health, OpenAI vision, etc.)

We may perform scheduled maintenance or updates that temporarily affect the availability of the Service. We will endeavor to provide reasonable advance notice of any planned downtime.

11. Limitation of liability

To the maximum extent permitted by applicable law, TunariVPN Sp. z o.o., its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to, use of, or inability to use the Service
Reliance on AI-resolved nutrition values for medical, dietary, or treatment decisions
Any unauthorized access to or alteration of your data
Any third-party conduct on or related to the Service

Our total aggregate liability to you for all claims arising from or related to these Terms or the Service shall not exceed the total amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable consumer-protection law (including, in the EU, liability for death or personal injury caused by our negligence).

12. Termination

You may terminate your account at any time through Settings → Delete account in the app or by emailing [email protected]. Upon termination:

Your right to access and use the Service will cease immediately
We will delete your account data within 30 days, in accordance with our Privacy Policy and applicable retention laws
App Store subscriptions are managed by Apple — you must cancel separately in Settings → Apple ID → Subscriptions to stop further charges

We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe that you have violated these Terms or engaged in fraudulent or illegal activity. Termination for cause does not entitle you to a refund.

13. Changes to these Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a prominent notice within the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

14. Governing law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions. To the extent applicable, the laws of the European Union, including the General Data Protection Regulation (GDPR), shall also apply.

Any dispute arising from or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of Warsaw, Poland, unless mandatory consumer-protection laws in your jurisdiction provide otherwise.
